Brief Overview:

It is a fact of modern life that an enormous volume of information is created, exchanged, and stored electronically in our usiness and ersonal lives.  ore commonly, a majority of legal cases involve a digital spect that, if properly uncovered and examined, digital evidence an help build stronger cases and occasionally to force settlements.  Recovering a particular email, a deleted memo, or the date and time a web page was printed can be critical to a legal matter.  More often than not, discovering when, how, and who created the digital information can be equally important and perhaps the smoking gun.  In other instances finding hidden or deleted financial information on a computer is the key to a strong case.

What you don't know about the DFS-Department of Financial Services regulations CAN HURT YOU!

Cyber and information security is a growing concern for both lawyers and clients. Recently, the New York Department of Financial Services has proposed comprehensive “first in the nation” cybersecurity regulations that is proposed to take effect January 1, 2017. 

These regulations will apply not only to all businesses regulated by the NYDFS, but also their outside counsel and other vendors...even if you are located in New Jersey.  

This 3 hour CLE will be broken into two sessions. We will begin with a discussion and analysis of the legal and practical implications of the new NYDFS regulations and their potential impact on outside counsel, including how the regulations intersect and differ from the confidentiality requirements of the Rules of Professional Conduct regardless of if you practice in NJ,NY, PA, or elsewhere.

In the second half of the presentation, using the NYDFS regulations as a framework, the panel will walk through a mock-scenario of a ransomware attack on a law firm’s information systems. This discussion will cover the technical, liability, and insurance coverage issues that may arise as a result of this and similar cybersecurity events. 

We also will integrate the RPC and how the rules being changed regards to attorneys ethical obligation to understand technology, confidentiality, and cyber awareness.

E-Discovery Session for Seton Hall Law School Students

Rob Kleeger will return to Professor Fernando Pinguelo’s e-discovery class for an "In Class Simulation."  Students will get their fact patterns for the simulation in a Q&A of Mr. Kleeger.

The first portion of the class will be Rob Kleeger playing the role of an IT director for a Defendant in a contract breach claim.  His role then will shift to be the role of a highly compensated CIO who plays the corporate politics game extremely well, yet doesn’t really know much about technology other than throwing around buzzwords and techie acronyms.  

The students use probing questions to determine what the respective Plaintiff and Defendant’s IT Data Map looks like in order to properly identify, preserve, and prepare for a meet and confer conference in the upcoming weeks. 

The third “act” will be the meet and confer where both attorneys simulate a joint discovery plan in preparation for a Case Management conference with the Judge.
